First things first. If you have been contacted by law enforcement, it is important to get a lawyer before responding.  Remember, The Fifth Amendment, or “the right to remain silent”, ensures the protection against self-incrimination, a fundamental right in the United States. In other words, you cannot be forced to provide evidence or testimony that could be used against you in a criminal case.  Therefore, you should never respond to law enforcement until you seek out an attorney.

It can also be financially frustrating.  And every penny counts.  That’s why it is important to have MedPay coverage on your insurance policy.

MedPay is the shortened version for the term “Medical Payments Coverage.”  It works similar to your health insurance, but goes immediately into effect following a car accident.

While Georgia does not require each driver to have MedPay, it doesn’t hurt to have it and, may be extremely valuable in the long run.

When can MedPay be useful?
<ol>
 	<li>If the at-fault driver did not have adequate or outdated insurance coverage or if the at-fault driver’s insurance coverage is disputing the driver’s liability. MedPay can help compensate for some of the damages.</li>
 	<li>If your health insurance provider has paid for some of the medical bills, but you still have outstanding balances remaining. In that situation, MedPay could step in and alleviate some of those medical balances, co-pays, or other deductibles.</li>
</ol>
Note: Under Georgia law, insurance companies must reimburse you for reasonable and necessary medical and funeral expenses. However, they can deny MedPay coverage if certain medical treatments are deemed unnecessary or unreasonable.

Who might benefit from MedPay in a crash?
<ol>
 	<li>The insurance policy holder of that particular vehicle that has MedPay coverage.</li>
 	<li>The passengers in the particular vehicle that has MedPay coverage.</li>
 	<li>Someone who drives the vehicle that has MedPay coverage, with the permission of the vehicle owner.</li>
</ol>
It is important to note that MedPay benefits and coverage can vary based on various insurance companies and policy holders.

Your auto coverage can make or break what sort of compensation you receive in a personal injury automobile case.  Therefore, it is important to know what you should have to ensure you are protected.

#1.  <u>Liability Coverage</u>.  Liability insurance covers medical or repair costs for other people if you cause an accident.  Almost every state requires you to have liability coverage.

#2. <u>Uninsured Motorist (UM) and Underinsured Motorist (UIM) Coverage. </u>  Uninsured motorist coverage (or UM) covers medical expenses (for you and those in the vehicle) that may result from a drive who is uninsured.  It is not a mandate in Georgia, but it’s an affordable add-on to ensure you are protected. Underinsured motorists insurance (also known a UIM) covers you when you are in an accident caused by a driver who has insufficient coverage.

#3. <u>Medical Payments Coverage (also known as MedPay).</u>   MedPay coverage pays reasonable medical expenses for you, your passengers, or any of your family members that may be involved in a crash.  While your health insurance may cover some of your injury costs, MedPay is a nice additional financial benefit for your injuries. Speak to your insurance agent as to the costs for MedPay and how this may help you.

#4. <u>Rental Reimbursement.</u>  In the event your accident requires time in the shop, rental coverage can help.  This will cover the cost of the rental car while your vehicle is being repaired.  Rental reimbursement ranges up to a specific dollar for a specific number of days.  Again, check with your individual insurance company as to the cost.
